2. Applicable regulations

This Privacy Policy complies with the applicable personal data protection regulations, in particular Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 (LOPDGDD).

3. Personal data we process

Through the Website we may process identification and contact data such as name, surname, email address and telephone number, as well as any data the User includes in their message or request. We do not process special categories of data (Art. 9 GDPR).

4. Purposes of processing

  • Manage requests and communications sent by the User (e.g., information or contact requests).
  • Manage registrations/sign-ups when the Website allows registration through forms.
  • Security and abuse prevention: protect the Website and forms against automated submissions (spam) and malicious use.
  • Cookie-less analytics: we may measure aggregated usage of the Website through self-hosted analytics tools without cookies (e.g., Plausible) for statistical purposes and service improvement.
  • Email updates (newsletter): if the User opts in, we may send email updates and occasional communications about JCM Technologies.

Email updates and occasional communications will only be sent if the User has opted in, and can be unsubscribed from at any time.

5. Legal basis for processing

  • Art. 6(1)(b) GDPR: performance of a contract or pre-contractual steps, to manage registrations/sign-ups, handle requests and respond to enquiries sent through forms.
  • Art. 6(1)(f) GDPR: legitimate interests, to ensure Website security, prevent abuse and spam (e.g., via anti-bot mechanisms such as Cloudflare Turnstile) and to carry out cookie-less analytics for statistical purposes and service improvement.
  • Art. 6(1)(a) GDPR: the User's consent, to send email updates/newsletters (where the User has opted in). Consent can be withdrawn at any time.

Where consent is required (e.g., email updates/newsletters), it will be requested explicitly through a specific mechanism (Art. 6(1)(a) GDPR).

The “I have read the Privacy Policy” checkbox in forms is used as evidence that the User has been informed and does not, by itself, constitute the legal basis when processing is necessary to handle the User's request.

6. Recipients and processors

Personal data will not be disclosed to third parties, except where required by law or where necessary to provide the service (e.g., technology providers acting as data processors).

In particular, we may use Cloudflare Turnstile (Cloudflare, Inc.) in forms as an anti-spam measure. This may involve the communication of certain technical data (e.g., IP address and browser/device information) to verify that the interaction is not automated.

If we use self-hosted cookie-less analytics (e.g., Plausible), the data is not shared with third parties for that purpose, as it is a solution managed by JCM Technologies SAU on its own infrastructure.

7. International data transfers

As a general rule, the Website seeks to ensure that processing and hosting are carried out within the European Union. If, due to specific providers, international data transfers occur, they will be carried out with appropriate safeguards under the GDPR and the User will be informed where required.

8. Data retention

Data will be kept for as long as necessary to handle the request, manage the registration/sign-up or maintain the relationship arising from the form, and thereafter for the periods required to address potential legal liabilities. When no longer necessary, it will be deleted or anonymised. For email updates/newsletters, we will keep the data until the User unsubscribes or withdraws consent.

9. Minors' data

In Spain, only users aged 14 or older may provide consent for the processing of their personal data in relation to information society services. If a user under 14 provides personal data, consent from their parent/legal guardian will be required.

10. Security measures

Install Tour by JCM Technologies implements reasonable technical and organisational measures to protect personal data. The Website uses secure protocols (e.g., HTTPS/SSL) to reduce the risk of unauthorised access.
